SMS / Text Messaging Terms

By submitting your mobile number through the opt-in form at augustseo.com/sms-opt-in and checking the consent box, you ask August SEO, LLC ("August SEO") to send you text messages about your inquiry and your ongoing project. Enrollment uses double opt-in: we send one confirmation text, and you are subscribed only once you reply YES. These messages are business-initiated and may be sent automatically by our systems. We do not send marketing or promotional texts through this service. Message frequency varies. Message and data rates may apply. For help, reply HELP to any message or email mail@augustseo.com. To stop, reply STOP to any message — you’ll get one confirmation and no further texts. Carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes; text messaging originator opt-in data and consent are never shared with any third parties.

Client Responsibilities

To ensure effective service delivery, clients agree to:

• Provide accurate information when requested
• Grant necessary access to websites, hosting, analytics, and marketing platforms
• Respond to approvals, revisions, or feedback requests in a timely manner
• Maintain ownership or authorization for all digital assets provided

Payment Terms

Payment terms are defined within each service agreement. Unless otherwise specified: monthly services are billed in advance; one-time projects may require a deposit before work begins; invoices are due according to the terms listed on the invoice; late payments may result in paused or suspended services.

No Guaranteed Results

Search engine optimization and digital marketing involve many variables beyond the control of any agency. August SEO does not guarantee specific search rankings, traffic increases, lead or revenue outcomes, or search engine algorithm behavior. Search results may fluctuate due to search engine updates, competitor activity, and other market factors.

Intellectual Property

Clients retain ownership of their website, brand assets and trademarks, content produced for their business, and marketing accounts and data. August SEO retains ownership of internal systems and tools, research methodologies, marketing frameworks, and proprietary software and automation processes.

Limitation of Liability

To the maximum extent permitted by law, August SEO shall not be liable for indirect or consequential damages, lost profits or revenue, search engine ranking changes, website downtime caused by third parties, or data loss due to external systems. Total liability for any claim related to services shall not exceed the fees paid for the relevant service period.

Confidentiality

Both parties agree to maintain confidentiality regarding sensitive business information shared during the course of services, including marketing strategies, website analytics, customer data, financial information, and internal business operations. This information will not be disclosed without consent unless required by law.

Termination of Services

Either party may terminate services according to the terms defined in the applicable service agreement, which may include written notice before cancellation, payment of outstanding invoices, and transfer of relevant access credentials or assets. August SEO reserves the right to terminate services immediately in cases of fraud, abuse, illegal activity, or violation of these terms.

Changes to Terms

August SEO may update these Terms & Conditions periodically. Updates will be posted on this page along with the revised effective date. Continued use of the website or services after updates indicates acceptance of the revised terms.

Governing Law

These Terms & Conditions are governed by the laws of the State of Washington, United States. Any disputes arising from these terms shall fall under the jurisdiction of the Washington State courts located in Spokane County.
